Welcome to Impact Forge LLC ("Impact Forge," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our games (including Battlespace), websites, applications, and related services (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By creating an account, downloading our games, or otherwise accessing our Services, you affirm that:

• You are at least 13 years of age (or the age of legal majority in your jurisdiction)
• If you are between 13 and 18, you have obtained parental or guardian consent
• You have the legal capacity to enter into a binding agreement
• You will comply with these Terms and all applicable laws and regulations

If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

• Download and install our games on devices you own or control

5.2 User-Generated Content

Our Services may allow you to create, upload, or share content ("User Content"). You retain ownership of your User Content, but by sharing it through our Services, you grant us:

• A worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with our Services
• The right to use your username and likeness in connection with your User Content

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not infringe third-party rights
• Your User Content complies with these Terms and applicable laws

5.3 Content Moderation

We reserve the right, but have no obligation, to:

• Monitor, review, or remove User Content at our discretion
• Take action against users who violate these Terms
• Cooperate with law enforcement regarding illegal activities

6. Intellectual Property Rights

6.1 Our Rights

All content, features, and functionality of our Services, including but not limited to:

• Software, code, and technology
• Graphics, artwork, animations, and visual designs
• Audio, music, and sound effects
• Text, dialogue, and storylines
• Trademarks, logos, and branding
• Game mechanics and systems

...are owned by Impact Forge LLC, our licensors, or other content providers, and are protected by intellectual property laws including copyright, trademark, patent, and trade secret laws.

6.2 Third-Party Technology

Our games are developed using Unreal Engine, which is licensed by Epic Games. Your use of our Services is also subject to the Unreal Engine End User License Agreement.

6.3 Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas about our Services, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback without compensation or attribution.

7. Virtual Items and In-Game Purchases

7.1 Virtual Currency and Items

Our Services may include virtual currency, items, or other digital goods ("Virtual Items") that can be purchased or earned. You acknowledge that:

• Virtual Items have no real-world monetary value
• Virtual Items are licensed, not sold
• You do not own Virtual Items; you have a limited license to use them
• Virtual Items are non-transferable and cannot be exchanged for real currency
• We may modify, remove, or discontinue Virtual Items at any time

7.2 Purchases

All purchases are final and non-refundable, except:

• Where required by applicable law
• In cases of technical errors or unauthorized transactions
• At our sole discretion

Prices are subject to change without notice. You are responsible for all applicable taxes.

8. Privacy and Data Collection

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the practices described in our Privacy Policy.

Our games use Unreal Engine, and Epic Games may collect certain data as described in the Epic Games Privacy Policy.

10. Disclaimers and Warranties

10.1 "AS IS" Basis

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of content

10.2 No Guarantee

We do not guarantee that:

• Our Services will meet your requirements or expectations
• Our Services will be available at all times
• Defects will be corrected
• Our Services are free from viruses or harmful components

10.3 Beta and Early Access

Some features or games may be designated as "beta," "early access," or similar. These are provided for testing purposes and may contain bugs, errors, or incomplete features. Use at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPACT FORGE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of or damage to property
• Personal injury or emotional distress
• Business interruption

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless Impact Forge LLC, its officers, directors, employees, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law principles.

13.2 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally by sending a written notice to [email protected]. We will attempt to resolve the dispute informally within 60 days.

The arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) rules. The arbitrator's decision will be final and binding.

13.4 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13.5 Jurisdiction (Non-US Users)

If you are located outside the United States, you agree to submit to the personal jurisdiction of the courts located in [Your Jurisdiction], and any disputes will be resolved in those courts.

14.1 By You

You may stop using our Services at any time. You may delete your account through account settings or by contacting us.

14.2 By Us

We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice, including for:

• Fraudulent or illegal activity
• Harm to other users or our business
• Extended inactivity
• Discontinuation of Services

14.3 Effect of Termination

Upon termination:

• Your license to use our Services immediately terminates
• You must cease all use of our Services
• We may delete your account and data
• You will not be entitled to any refunds
• Sections of these Terms that by their nature should survive termination will survive

15. Updates and Modifications to Services

We reserve the right to:

• Modify, update, or discontinue any aspect of our Services at any time
• Change game features, Virtual Items, or pricing
• Perform scheduled or unscheduled maintenance
• Impose limits on features or restrict access to parts of our Services

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. These Terms will bind and inure to the benefit of the parties and their permitted successors and assigns.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us, constitute the entire agreement between you and Impact Forge LLC regarding our Services and supersede all prior agreements and understandings.

23. Force Majeure

We will not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

25. Special Provisions for Specific Platforms

25.1 Apple App Store

If you download our games from the Apple App Store:

• These Terms are between you and Impact Forge LLC, not Apple
• Apple has no obligation to provide support or maintenance
• Apple is not responsible for addressing claims relating to the game
• You represent that you are not located in a country subject to a U.S. government embargo

25.2 Google Play Store

If you download our games from Google Play, you agree to the current Google Play Terms of Service.

25.3 Steam

If you access our games through Steam, you are also subject to the Steam Subscriber Agreement.

25.4 Epic Games Store

If you access our games through Epic Games Store, you are also subject to the Epic Games Store End User License Agreement.
